Federal Authorities Examine Allegations Against AOC Over Undocumented Staffer

Federal agencies have reportedly launched an inquiry into Representative Alexandria Ocasio-Cortez (D–NY) amid claims that her congressional office knowingly employed an undocumented immigrant and assisted others in avoiding Immigration and Customs Enforcement (ICE) actions.
According to statements attributed to former Border Czar Tom Homan, the Department of Homeland Security has initiated a review after receiving information suggesting that a staff member in Ocasio-Cortez’s office—allegedly lacking legal immigration status—may have played a role in advising individuals on how to evade ICE scrutiny.
Speaking during an interview with conservative media personality Benny Johnson, Homan confirmed that federal authorities are actively reviewing the matter. He emphasized that the concern extends beyond individual immigration violations, alleging that guidance was given to help others avoid enforcement, which could constitute a criminal offense under federal law.
If substantiated, the accusations could involve serious violations, including the employment or harboring of unauthorized immigrants and interference with immigration enforcement efforts. Homan stressed that congressional status does not place anyone beyond accountability, stating that legal consequences would follow if the claims are proven accurate.
Individual Named in the Investigation
The inquiry is reportedly centered on Diego de la Vega, who began serving as Deputy Communications Director for Ocasio-Cortez in 2022. De la Vega has been politically active for years and previously held roles with other Democratic lawmakers despite questions surrounding his immigration status.
Reports indicate that de la Vega voluntarily left the United States earlier this year, citing personal safety concerns after renewed enforcement efforts targeting undocumented individuals employed by the federal government. His past work includes positions with former New York Assemblymember Robert J. Rodriguez and an internship under Rep. Carolyn Maloney—both allegedly during a period when he lacked lawful status.
Ocasio-Cortez has previously spoken highly of de la Vega, describing him in earlier interviews as a dedicated team member and a reflection of the “American dream.”
What Prompted Federal Action
Sources within DHS claim that Homan formally referred the case to the Deputy Attorney General earlier this year, requesting a Justice Department review. The referral reportedly followed public reports that Ocasio-Cortez’s office hosted informational sessions aimed at helping undocumented residents understand how to respond to ICE activity—events critics argue went beyond advocacy and into obstruction.
The Trump administration has placed renewed emphasis on immigration enforcement and vetting within federal employment. Officials have reiterated that knowingly aiding or employing unauthorized immigrants may trigger penalties under federal immigration statutes.
Response From AOC’s Office
As of now, Ocasio-Cortez’s office has not released an official statement addressing the investigation. In the past, her team has characterized similar claims as politically driven attacks, arguing that such accusations attempt to frame humanitarian advocacy as criminal behavior.
The congresswoman has consistently pushed for sweeping immigration reform, openly criticizing ICE and federal enforcement practices, which she has labeled inhumane. Nonetheless, the current allegations raise complex legal questions regarding the boundaries between advocacy and compliance with federal law.
Should investigators conclude that immigration laws were violated, potential consequences could range from ethics inquiries to civil or criminal penalties, depending on the findings.
